The website available at www.polariscampus.com, mobile application, and related services (collectively, the "Service") are operated by FutureTalks ("FutureTalks," "us," or "we"). By accessing or using any part of the Service, you agree that you have read, understood, and agree to be bound by these Terms and Conditions of Service ("Terms and Conditions"). FutureTalks may amend, update or change these Terms and Conditions. If we do this, we will post the changes on this page and indicate at the top of this page the date these Terms and Conditions were last revised. Any changes will be effective immediately. Your continued use of the Website after the date any such changes become effective constitutes your acceptance of the new Terms and Conditions.


Description of Service

The Service allows users to access various computer science training programs designed by Polaris School of Technology. These programs are targeted towards undergraduates and professionals, and may include applications introduced by FutureTalks from time to time. Each program is referred to as a "Cohort." FutureTalks reserves the right, at its sole discretion, to add, change, suspend, or discontinue all or any part of the Polaris School of Technology offerings at any time. Your continued use of the Service following the posting of any changes (including the addition or removal of features) constitutes your acceptance of those changes.

Any information you provide to us for registration and account setup (as specified below) must be accurate, complete, and kept up-to-date. You are solely responsible for all activity that occurs on your account, including activity by others you authorize to access it. You are also responsible for maintaining the security of your account and any information you input. We are not responsible for the accuracy or legitimacy of any information, data, or user data uploaded or posted on the Platform. To be clear, as long as your account is accessed with the correct login credentials and we haven't been notified of unauthorized access, you are solely responsible for all actions and omissions related to your account.


Registration

As part of the registration process, you will need to accept our Terms and Conditions and provide us with your name, phone number, and email address. In certain scenarios, we may also require your parent/guardian's contact information. We will never request access to your password unless you have explicitly given us written permission to do so, typically for assistance or support.

By registering for and using the Service, you agree to:

  • Provide accurate, current, and complete information about yourself and/or your organization (if applicable).

  • Maintain the confidentiality of your password and other account security information, and not share it with anyone.

  • Maintain and promptly update any registration information you provide to FutureTalks to keep it accurate, current, and complete.

  • Be fully responsible for all use of your account and any actions that take place through it.

  • By signing up, you agree to be contacted by us via phone calls, emails, and/or SMS notifications regarding our services, product knowledge, promotional offers, offers from third-party partners, and order/shipment/delivery updates. You authorize FutureTalks to contact you for these purposes even if you are registered with a Do Not Call (DNC) or similar service.


Your Representations and Warranties

You warrant that your access and use of the Service will comply with these Terms and Conditions, all applicable laws, rules, and regulations (including those regarding online conduct, acceptable content, data transmission, and exported information).


Inappropriate Use

You will not upload, display, or provide content that is:

  • Libelous, defamatory, abusive, threatening, harassing, hateful, offensive, or violates any law or third-party right (including copyright, trademark, privacy, publicity, or other personal or proprietary rights).

  • In FutureTalks' sole judgment, objectionable or restricts/inhibits others from using the Service or exposes FutureTalks or its users to harm or liability.

You will not use the Services in a way that could damage, disable, overburden, or impair our servers or any connected networks. You will not attempt unauthorized access to functions, user accounts, computer systems, or networks connected to our servers through hacking, password mining, or other means. You will not obtain or attempt to obtain materials or information not made available through your account or the Services.

The Services are provided on a non-exclusive, non-transferable, non-sublicensable, limited license basis for your own use only. You are granted a limited right to access website materials. These Terms and Conditions do not grant users access to the source code or constitute a license to it. You shall not, by yourself or through any third party:

  • Make and/or distribute copies of the Services or any deliverables generated by them.

  • Attempt to copy, reproduce, alter, modify, and/or reverse engineer the Services.

  • Create derivative works of the Services.


Indemnification of FutureTalks

You agree to defend, indemnify, and hold harmless FutureTalks, its affiliates, directors, officers, employees, contractors, agents, suppliers, licensors, successors, and assigns from any and all losses, claims, causes of action, obligations, liabilities, and damages (including attorneys' fees) arising out of or relating to:

  • Your access or use of the Service.

  • Any false representation made to us.

  • Your breach of any Terms and Conditions.

  • Your violation of any law or third-party rights (including intellectual property infringement).

  • Any claim that a Service we provide is inaccurate, inappropriate, or defective.


User Acknowledgment

The Website solely facilitates the provision of Services, and we have no direct or indirect control over conversation content. You use the Services at your own risk and assume responsibility for any loss or harm resulting from such conversations or recommendations. FutureTalks and its directors or officials will not be held liable for any such loss or harm.


Disclaimer

The Polaris School of Technology services and content are provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to the implied warranties of title, non-infringement, merchantability and fitness for a particular purpose, and any warranties implied by any course of performance or usage of trade. All of these are expressly disclaimed. FutureTalks and its directors, employees, agents, suppliers, sponsors, and partners do not warrant that:

  • The Services or Platform will be secure, error-free, or available at any particular time or location.

  • Any defects or errors will be corrected.

  • Any content or software available on the Platform is free of viruses or other harmful components.

  • The results of using the Platform will meet your requirements.

The Services may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications. FutureTalks is not responsible for any delays, delivery failures, or other damage resulting from such problems. Your use of the platform and the Services is solely at your own risk.


Limitation of Liability

Neither FutureTalks nor any of its affiliates, employees, directors, officers, shareholders, agents, representatives, vendors, or suppliers will be liable to you or anyone else for any indirect, special, incidental, or consequential losses or damages arising out of or related to your use or inability to use the Services. This includes, but is not limited to, lost profits, lost goodwill, lost data, work stoppage, inaccurate search results, or computer/electronic device failure, viruses, or malfunctions. FutureTalks' total liability for any damages arising out of or related to your use of the Services will not exceed the fees you paid for the Services.


Termination

FutureTalks may deactivate your account or terminate your use of the Website or Services at any time, with or without cause. Reasons for termination may include, but are not limited to, your breach of these Terms and Conditions, infringement of a third party's intellectual property rights, or violation of the spirit or letter of these Terms and Conditions or any applicable code of conduct. You agree that FutureTalks may terminate your access to the Services without prior notice and will not be liable to you or any third party for such termination. FutureTalks may also retain and store your information on its systems even after termination of your account.


Cancellation Policy

Products offered with special promotions or discounts by the FutureTalks marketing team, including but not limited to those for New Year, festivals, specific occasions, or exams, are not eligible for cancellation. These are limited-time offers, and cancellations are not possible.


Refund Policy

The application fee of 1500 INR is non-refundable.


Payment

To make a payment for a Cohort or other services or products offered by FutureTalks on the Platform, you will need internet access and a valid payment method accepted by the Platform ("Payment Method"). FutureTalks does not store your credit card information or other sensitive data used for payment processing. We partner with third-party payment gateways for secure transactions. By using a third-party payment provider, you agree to abide by their terms and policies. You acknowledge that FutureTalks is not responsible for any storage of your payment information by the third-party provider. It is at your discretion to allow them to store such information according to their terms and policies. FutureTalks will not be liable for the loss of such information or any loss incurred by you due to its misuse. You are also responsible for paying all applicable fees for payments made through the Platform. FutureTalks does not support all payment methods, currencies, or locations for payment. Applicable taxes will be calculated based on the billing information you provide at the time of enrollment/purchase. Your transactions may be subject to foreign exchange fees or rates.


Proprietary Rights in Service Content and Activity Data

All content available through the Service, including designs, text, graphics, images, information, software, audio, blogs, testimonials, and other files, and their selection and arrangement (the "Service Content"), are the property of FutureTalks or its licensors. You may not modify, copy, distribute, frame, reproduce, republish, download, scrape, display, post, transmit, or sell any Service Content in whole or in part, in any form or by any means, except as expressly permitted in these Terms and Conditions. You may not use data mining, robots, scraping, or similar data gathering methods to obtain Service Content.

Data and information generated from your access and use of the activities made available on or through the Service, including translated content generated by you (collectively, the "Activity Data"), are exclusively owned by FutureTalks. You have no right to use such Activity Data except as expressly authorized by these Terms and Conditions. By using the Service, you hereby assign to FutureTalks any and all rights, titles, and interests, including any intellectual property rights or proprietary rights, in the Activity Data. All rights of FutureTalks or its licensors that are not expressly granted in these Terms and Conditions are reserved.


Trademarks

All trademarks, service marks, graphics, and logos used in connection with the Service are trademarks or service marks of FutureTalks or their respective owners. Access to and use of the Service do not grant you the right or license to reproduce or otherwise use the FutureTalks name or any FutureTalks or third-party trademarks, service marks, graphics, or logos.


Privacy

Your use of the Service is also governed by our Privacy Policy, located here. By using the Service, you consent to the terms of the Privacy Policy.

Third-Party Intellectual Property

FutureTalks respects third-party intellectual property rights, including copyrights and trademarks ("IP"), and actively enforces their protection. We respond promptly to clear notices of alleged IP infringement. If we receive a proper notification, we will remove or disable access to the allegedly infringing material.

To report a copyright or IP infringement, please provide us with the following information:

  • An electronic or physical signature from someone authorized to act on behalf of the IP owner.

  • A description of the copyrighted work or IP you claim has been infringed.

  • A description of the location of the allegedly infringing material on the Website.

  • Your contact information (address, phone number, and email address).

  • A statement that you believe in good faith that the disputed use is not authorized by the IP owner, its agent, or the law.

  • A statement under penalty of perjury that the information in your notice is accurate and that you are authorized to act on behalf of the IP owner.

However, FutureTalks does not endorse or take responsibility for any third-party services mentioned on the Website. We are not liable for any acts or omissions of third parties. Transactions, dealings, or communication with such third parties are at your own risk. We make no warranties regarding the quality or suitability of services or products from such third-party vendors. Clicking on such links may redirect you to third-party websites governed by their own policies. FutureTalks is not responsible for any transactions or information dissemination on these websites. You acknowledge and agree that FutureTalks is not liable for any loss or damage from dealings with such third parties. FutureTalks uses third parties to assist in providing Services. You acknowledge that these third-party services are subject to their own policies, which may change from time to time. It is your responsibility to stay informed of these changes. FutureTalks will not notify you of any such amendments.


User Guidelines

In consideration of FutureTalks granting you access to the Services, you agree to use the Website only for lawful purposes and in accordance with these Terms and Conditions. You will not use the Website in any way that could damage, disable, overburden, or impair any networks connected to our servers or interfere with anyone else's use of the Website.

You will not attempt unauthorized access to any functions, features, user accounts, computer systems, or networks connected to our servers through hacking, data or password mining, or any other means. You will not obtain or attempt to obtain or extract any materials, data, or information through robots or any means not intentionally made available to your account or through the Website.

The Website is provided to you on a non-exclusive, non-transferable, non-sublicensable, limited license basis for your use alone. Nothing in these Terms and Conditions grants you or any other person access to or use of the source code or constitutes a license to it. You shall not allow third parties to:

  • Make and/or distribute copies of the Website or any deliverables generated by it.

  • Attempt to copy, reproduce, alter, modify, and/or reverse engineer the Website.

  • Create derivative works of the Website.

You understand that all activity from your device is assumed to be initiated by you.

You will not use the Website to transmit, distribute, or send viruses, worms, or any other code that may be harmful or destructive.

You will not copy, reproduce, distribute, create derivative works of, or modify the content available on the Website. You will not attempt to decompile, reverse engineer, or reverse compile our technology/software available on the Website or transfer the material to another person or "mirror" the material on any other server.

You will not engage in or use any data mining, robots, scraping, or similar data gathering or extraction methods.

If your device is lost or stolen, you must request that FutureTalks block your account and change your password immediately.

You are responsible for all activity in your account. You agree to notify FutureTalks immediately of any unauthorized use or security breach. FutureTalks will not be liable for any loss caused by your negligence, including failure to report a lost or stolen device or unauthorized account access within a reasonable time.


Third-Party Use and Personal Information

You are liable for losses incurred by FutureTalks or others due to a third party using your account. Don't use another person's account without their and FutureTalks' permission.

FutureTalks makes reasonable efforts to keep your information confidential. However, we are not responsible for disclosure or leakage due to theft, negligence, or your failure to practice safe computing.

Avoid sharing personal information about yourself or others, including contact details, social media profiles, etc.


Compliance

While using the platform, you agree to comply with all applicable laws and regulations. FutureTalks is not liable for any non-compliance by you.


Third-Party Access

By using the Website, you authorize FutureTalks to access third-party sites on your behalf to retrieve information or register for accounts you request. You grant FutureTalks limited power of attorney to act as your agent in these interactions. You acknowledge that FutureTalks acts as your agent and not the third party's agent when accessing their information.


Acceptable Use Policy

FutureTalks provides a platform for online courses. To ensure a smooth experience for all users, you agree to use the Service only in accordance with this Acceptable Use Policy:

  • Prohibited Content: You agree not to post content that is:

    • Sexually explicit or pornographic.

    • Likely to cause harm, loss, injury, emotional distress, or death to yourself, others, or animals.

    • Harmful or exploitative to children.

    • Illegal or that encourages illegal activity.

    • Hateful, violent, abusive, discriminatory, defamatory, infringing, or invasive of privacy.

    • Harassing, humiliating, libelous, threatening, profane, or otherwise objectionable.

    • Illegal (including sharing insider information or trade secrets).

    • Infringing on intellectual property rights or other rights.

    • Information you don't have the right to share.

    • Fraudulent, false, misleading, or deceptive.

You agree not to engage in any of the following prohibited activities:

  • Use, display, mirror or frame the Service, any individual element within the Service, the FutureTalks name, trademark, logo or other proprietary information, or the layout and design of any page, without our express written consent.

  • Access, tamper with, or use non-public areas of the Service, our computer systems, or the technical delivery systems of our providers.

  • Attempt to probe, scan, or test the vulnerability of any FutureTalks system or network or breach any security or authentication measures.

  • Avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by FutureTalks or any of our providers or any other third party to protect the Services or FutureTalks content.

  • Attempt to access or search the Services, user content or FutureTalks content or scrape or download content using automated tools other than generally available web browsers.

  • Send any unsolicited or unauthorized spam, advertising messages, promotional materials, junk mail, chain letters, or similar solicitation.

  • Use any meta tags or hidden text utilizing a FutureTalks trademark, logo, URL, or product name without express written consent.

  • Use the Service for any commercial purpose or for the benefit of any third party, except as explicitly permitted.

  • Use FutureTalks user information to forge headers or send altered, deceptive or false source-identifying information.

  • Attempt to decipher, decompile, disassemble or reverse engineer any software used to provide the Services.

  • Interfere with access of any user, host or network, including sending viruses, overloading, flooding, spamming, or mail-bombing the Services.

  • Collect or store personally identifiable information from other users without their express permission.

  • Impersonate or misrepresent your affiliation with any person or entity.

  • Violate any applicable law or regulation.

  • Request, collect or store usernames, passwords, tokens or other account authentication information from other users.

  • Encourage or enable any other individual to do any prohibited activity under this Acceptable Use Policy.

  • Share your account credentials with your friend/relative or anyone else in order to study from a common account.

FutureTalks reserves the right, but is not obligated, to remove any user content for any reason or for no reason, including content that FutureTalks believes violates this Acceptable Use Policy and/or its Terms and Conditions. FutureTalks may also permanently or temporarily terminate or suspend a user account without notice and liability for any reason.


Governing Law and Arbitration

These Terms and Conditions shall be governed by, construed and enforced in accordance with the laws in India. You agree that any legal action, lawsuit or other action brought by FutureTalks, you or any third party to enforce these Terms and Conditions, or in connection with any matters related to the Services, shall, subject to the arbitration process set out in this clause, be submitted only to the exclusive jurisdiction of the courts of New Delhi.

Where a dispute arises, the parties involved shall make all reasonable efforts to resolve the dispute through good-faith negotiations. If efforts to amicably resolve any dispute or claim between the parties are unsuccessful within 30 working days from the date of such written notice initiating the dispute, then such dispute or claim shall be referred to an arbitral tribunal comprising 3 (three) arbitrators, wherein each party shall appoint one arbitrator and the third arbitrator shall be appointed by the aforesaid two arbitrators. All proceedings in any such arbitration shall be conducted in English.

The arbitration shall be governed by the Arbitration and Conciliation Act, 1996 or any other law relating to arbitration in force in India at the relevant time. The seat and venue for arbitration shall be New Delhi. The parties to the dispute shall share the costs equally or in proportion as decided by the arbitrator/arbitral tribunal. The award rendered by the arbitrator shall be final and conclusive on both parties and shall be subject to execution in any court of competent jurisdiction.


Miscellaneous

If any provision of the Terms and Conditions is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. FutureTalks shall have no liability under these Terms and Conditions to the extent arising from any failure to perform obligations due to fire, flood, earthquakes, acts of God, war, civil unrest, terrorism, epidemic, pandemic, internet failures, governmental act or court order, national emergency, strikes, labour disputes, or any other event not within FutureTalks's reasonable control.

FutureTalks shall not be responsible for damage or other problems caused by unauthorized changes to these Terms and Conditions made by hacking or cracking this page. The failure of FutureTalks to exercise or enforce any right or provision shall not constitute a waiver of such right or provision.

By accepting the Terms and Conditions through your use of the Platform, you certify and acknowledge that you are 18 years of age or older. If you are under the age of 18 or under the legal age in your jurisdiction to enter into a binding contract, you must use the Platform only under the supervision of a parent or legal guardian who agrees to be bound by the Terms and Conditions.

If you are a parent or legal guardian agreeing to these Terms and Conditions for the benefit of an individual below 18 years of age, please be advised that you are fully responsible for his/her use of the Platform, including all financial charges and legal liability that he/she may incur.

By using the Platform, you represent and warrant that you have the right, authority, and capacity to enter into these Terms and Conditions and to abide by all of the terms and conditions set forth herein. These Terms and Conditions constitute the entire agreement between you and FutureTalks relating to the matters set forth herein.

If you are a minor or child who does not meet the age requirements, then you may not register for the Services, and only your parent can register on your behalf, agree to all website Terms & Conditions as well as the Privacy Policy, and enable access to you under their guidance and supervision.

While some of our services may require the collection of a minor or child’s personal information, we do not knowingly collect such personal information. In the event a minor or child utilizes the Services, it is assumed that he/she has obtained the consent of the parent/legal guardian.

FutureTalks will not be responsible for any consequences that arise as a result of misuse of our Services by any person including a minor or child. FutureTalks reserves the right to terminate your account and/or refuse access to the Services if it is discovered that you do not meet the age requirements and parental/legal guardian consent has not been provided.

If you are a parent/legal guardian and you are aware that your child has provided us with personal information without your consent, please contact us at support@polariscampus.com.

If your child faces bullying, abuse or harassment while availing our Services, please contact us at support@polariscampus.com.

FutureTalks may freely transfer or assign any portion of its rights or delegate its obligations under these Terms and Conditions. You may not transfer or assign any portion of your rights or delegate your obligations without prior written consent of FutureTalks.

In the event that you feel that your concern has not been resolved to your satisfaction, you may contact our Grievance Officer, who shall endeavor to redress the concern within 30 working days from the date of escalation.
